End-User License Agreement (EULA) for “What I Know”
PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PURCHASING, DOWNLOADING, OR USING THE SOFTWARE.
This End-User License Agreement (referred to as "EULA") is a legal agreement between you (referred to as “USER”) and Connor Shafran for the “What I Know” software (referred to as “SOFTWARE”).
By installing, copying, or otherwise using the SOFTWARE, the USER agrees to be bound by the terms of this EULA.
1. GRANT OF LICENSE
Connor Shafran grants the USER the right to use the SOFTWARE on their personal computers.
The USER may also make copies of the SOFTWARE for backup or archival purposes, but may not distribute them to other parties.
By purchasing the SOFTWARE, the USER may perform “What I Know” in front of public audiences and/or record themselves performing it in the form of video and/or audio.
Any performances of “What I Know” where the audience has to pay entry fees must be registered with ASCAP, GEMA, or whichever national/local performance-rights organization (PRO) applies to the country in which the USER resides.
2. LIMITATIONS
(a) The USER may not distribute copies the SOFTWARE to third parties.
(b) The USER may not sell, rent, lease, or lend the SOFTWARE to third parties.
(c) The USER may not transfer or give their copy of the SOFTWARE to a third party.
(d) The USER may not remove or alter any copyright notices contained within the SOFTWARE.
(e) The USER must adhere to any and all applicable local, national, or international laws regarding use of the SOFTWARE.
3. COPYRIGHT
The SOFTWARE – as well as the musical composition itself – is copyrighted and protected as intellectual property under German law (Urheberrecht) and international treaties. All rights not explicitly granted in this EULA are reserved by Connor Shafran.
4. WARRANTY
The SOFTWARE and its accompanying files are provided “AS IS” without warranty of any kind. Connor Shafran can not be held liable for any damages (including, but not limited to: loss of profit, loss of reputation, or business disruptions) caused through use or misuse of the SOFTWARE.
Connor Shafran can not be held liable for damages to the USER’s musical equipment, hardware, data, software, or health.
Connor Shafran can not be held liable for damages caused to third parties (including, but not limited to: damages caused to members of a live or digital audience) by the USER’s use or misuse of the SOFTWARE.
The USER agrees to take the utmost caution when using the SOFTWARE in situations that might damage or otherwise affect human hearing (including, but not limited to: volume, distortion, and feedback). Connor Shafran is not liable or morally responsible for any form of hearing damage or other health complications that arise from use of this SOFTWARE.
The USER agrees to use the SOFTWARE at their own risk.
